Terms & Conditions
1. Acceptance of Terms
By engaging NIXI Property Group ("the Company"), clients agree to these Terms & Conditions. Services requested are deemed accepted upon confirmation of booking, signing of quotation, or commencement of work.
2. Scope of Services
All services are provided strictly in accordance with the selected package, quotation, or signed agreement. Any additional services beyond the agreed scope are considered separate and will be quoted, scheduled, and billed independently.
3. Pricing & Payment
- Pricing depends on property size, scope, materials, labor, site conditions, and operational risk.
- Clients providing materials may see adjustments in pricing; the Company is not responsible for quality or warranties on client-supplied items.
- Monthly services are billed on a recurring basis; once-off services are invoiced separately.
- Payment is due within seven (7) days unless otherwise agreed in writing.
- The Company reserves the right to suspend or terminate services in the event of late or non-payment, without prejudice to other rights or remedies.
4. Client Obligations
- Ensure safe, reasonable, and uninterrupted access to the property at the scheduled date/time.
- Disclose hazards, restricted areas, aggressive animals, or any risk factors prior to commencement.
- Provide accurate information regarding property conditions, accessibility, and any special requirements.
5. Risk, Liability & Indemnity
- The Company is not liable for pre-existing damage, hidden defects, structural faults, normal wear and tear, or indirect/consequential losses.
- Delays or service interruptions due to weather, load shedding, supplier delays, force majeure, or circumstances beyond reasonable control do not constitute breach of contract.
- Clients indemnify the Company against claims resulting from failure to disclose hazards, unsafe conditions, or client omissions.
6. Cancellation & Termination
- Monthly service cancellations require at least 30 days' written notice; failure may incur fees.
- Missed appointments, denied access, or last-minute cancellations may result in rescheduling or no-show fees.
- The Company reserves the right to terminate services immediately in unsafe conditions or breach of these terms.
7. Refunds & Dispute Resolution
- All services operate under a strict no-refund policy once commenced or completed.
- Clients may submit written notice within 48 hours of service completion if services are allegedly not delivered per agreed scope.
- The Company will assess claims, inspect, and rectify valid concerns; partial credits may be issued at the Company’s discretion.
- No refunds will be issued for delays or service limitations due to external factors (weather, force majeure, restricted access, emergencies).
- Disputes will first be handled via mediation; if unresolved, arbitration may be pursued in accordance with South African law.
8. Governing Law
These Terms & Conditions are governed and interpreted under the laws of the Republic of South Africa. The Company’s liability is limited to the value of services rendered.
9. Media & Marketing Consent
Clients acknowledge that photos/videos of work may be taken for marketing, portfolio, or training purposes unless expressly objected in writing prior to service commencement.
10. Amendments
NIXI Property Group reserves the right to update or amend these Terms & Conditions at any time. Updated terms will be posted online and communicated to clients where applicable.
